Rich, I like the guy, but he's wrong here.

Watch the video, maybe even just the first 3 minutes.  He goes on to say that Nintendo is wrong for taking down the game, calling Nintendo old for claiming all IP.  He goes on to say he's only a fan, doing it for the sake of fandom, not making money for his effort, Nintendo could have hired him to make them actual money.  Basically Rich says Nintendo is the horrible company that took down a fanboy amateur's (stolen)game.

Then I look at the youtube comments, basically broils down to, "I agree, Nintendo is mean, I side with rich, blah blah blah."

Well I don't see it that way.  Nintendo whether they have the law on their side or not(I'm not going to look up the rules on this) I don't care, they can, they did, and I agree with Nintendo on this as a company.  Try taking the Nike logo and sticking it to your vans and post it online and see what you get from Nike(The real big N.)

I point to Mario Maker.  They took a game like that down as well, and eventually we got Mario Maker and Mario Maker 2.  I'm so glad they took that fake fan made mario maker down because we ended up with the real mario maker.  And for those that think Nintendo stole those ideas.  Well they aren't new.  Nintendo has had ideas for games since the games came out.  Whenever Nintendo wants to make that kind of game, they'll do it when they see fit.  That's the problem the commenters don't understand.  Oh, nintendo is mean, well don't take their stuff.  There's ways to make games without taking Assets and IP from other companies.  Do you think that DCMA royal would be as famous as it was without Mario being the headliner?  No.  F-NO!  Same with you pokemon fan game creators.  Stop making them if you know Nintendo is going to take you down.  You're making them sound like they're the bad guys here when you knew the rules.  Its not so much that they made the game, but some of them are angry for it.  You know what, I'm going to eat a whole cake everyday for a whole week, then be angry that I gained 80 pounds.

Rich also states that Nintendo could have hired the guy to help them make the Mario Battle royale game.  To that I say, Nintendo doesn't need his help to make that game.  Nintendo is a Company employees first.  That is the reason why a lot of Nintendo employees never leave the company.  Nintendo isn't going to go to this guy to make a battle royal for them.  In fact, why would they?  This guy took their art, their style, their design, then went ahead and acted like he was such a grateful fan.  You know what happened?  He changed the name to "DMCA battle Royal," because he already had one ready, and because he wanted to stick it to Nintendo for shutting him down, something he already knew was going to happen, making his initial entrance of the game nothing but a tied-to a mario game advertisement.  It was no great fan love, it was riding on the back of a game, to get the notoriety(which he got).  Because it is a good idea for a game, only problem was he used Nintendo assets and IP.   You know what game makers do when they make games?  They make their own games and don't rely on other video games to garner attention.  How do I know he's just trying to get attention?  Follow the site below and you see the sour grapes from this guys mouth just foaming at Nintendo for something he knew was already going to happen.

Unfortunately, Uncle Nintindie's lawyers have informed me that, despite my best efforts, the game still infringes their copyright.
They refused to give me specifics (I asked multiple times) but it would seem that either the level design or general mechanics are still too close to the original game.

So what, does that sound like an avid Nintendo fan paying homage to something he really wanted to create, or just someone who is butt hurt that Nintendo took down his IP stealing game?

I really have no care what Nintendo does with their IP. They're within their right to protect the use of their IP. Getting angry about it literally does nothing and only makes those complaining about it look childish. The creator of Mario Royale handled it better and more professionally than those who played it originally.

I mean if what Nintendo was doing was legally wrong and Super Mario was a part of the public domain then yeah I'd be pissed, but it isn't. I just watched a Did You Know Gaming about Koji Kondo. In the video it was explained that Kondo wanted to use pre-existing music for Zelda's iconic theme but because it wasn't a part of the public domain, he couldn't use it. So what did he do? He made his own theme and it became hugely popular. He could have been sour about it but instead he took an unfortunate situation and made the best out of it. Much like the developer of Mario Royale did...

TLDR: Oh well.



IP is worth billions, thus worth protecting. It is that simple.



If you don't protect your IP, you lose it. They did what they had to.



I am all for publishers protecting their IPs. If they couldn't, why have IPs at all?

Welp, looks like Nintendo took down the entire game for good, even with the original assets. Don't know how to feel about this one. There's clones of their games that use original assets that cost money on their eShop. Now this is kind of dodgy.



Why use Nintendo IPs? Theres like a million others to choose from at this point...



Nobody should be allowed to stop others from using an idea. That's what patent and copyright law does.

With that said, this dude certainly should have known that this game wouldn't fly. Nintendo is the absolute worst in terms of being IP Nazis.
I wouldn't be surprised to hear that they are suing people for naming their kids Mario.



Yea next time take the effort to create your own assets then shouldn't have to worry about getting taken down.
