Bayonetta is a Sega IP and trademark, but they have to share the copyright for the games Bayonetta 2 and Bayonetta 3 with Nintendo, because Nintendo has funded those games. Because Nintendo has the copyright, neither Bayonetta 2 or Bayonetta 3 will appear on non-Nintendo platforms. Last year Sega ported Bayonetta 1 to the PC, but they can't do more than that.

Nintendo may not own Bayonetta 2 and Bayonetta 3 in their entirety, but they get to decide which platforms the games can appear on.

This thread counts Bayonetta 1 as third party game, but Bayonetta 2 and Bayonetta 3 are counted as first party due to the different legal circumstances.

Sorry, i've been away for a while. Anyway, is it really first party or is it merely publishing rights that Nintendo has? Microsoft used the same thing with Gears of War. People tried to argue whether Gears of War was first or third party and its quite clear last gen Gears was merely a third party exclusive with publishing rights. Microsoft only recently purchased the IP before they made the Coalition. Same thing with Sunset Overdrive. Microsoft only recently gave back publishing rights to Remedy for Alan Wake, so now they are free to do remasters anywhere they please for the specific game.

Bayonetta 2 and 3 are really first party. Nintendo funded the development, so they own the copyright for the games with Sega.

Bayonetta 1 is only published by Nintendo on Nintendo consoles, so it remains third party.

You just described publishing rights. This is why I used Gears of War as an example. Its an actual third party that became first party.
