Well it shouldn't be legal to sell the product before launch date, so technically the product does work if it's sold on the date it's legally meant to.

I don't know. Do you think it would be fine to sell a car that doesn't work unless you take it to the repair shop because the dealer sold it earlier than anticipated?

Also, we're talking about a disc game, something that can't be updated. You will need the patch to make it work no matter when you purchase the game.

The Xbox 1 didn't work without a day one patch if I recall correctly.

Seems similar..

To be fair they did advertise that as a "feature" at one point... So from a legal standpoint it might get treated differently.

It won't work after the launch date either if your internet connection is sub par or non-existent.

That is provided the content servers are even activated in 30 years time... Which means you would need to hunt around for a console that has the patch already downloaded to play this Physical release or enjoy a worthless coaster.
