And I don't see the correlation here.  Nintendo banning someone is an unreasonable repsonse.  This is a very reasonable response: when property is stolen, the wronged party can and should recover it.

Dude that had it early claimed to have not known it was stolen, paid full price for it.

Dude has not been refunded or even told if he will get it back on launch day (why would they not? it's just a retail system, nothing special)

Dude, if someone steals your stuff and then resells it, you don't refund the guy who bought it when you take it back even if he didn't know, that's just a plain silly thing to expect.  And why would he get it back for free?  None of the parties to whom the item belonged received any money in exchange for it.  And lastly, he claims he didn't know it was stolen and maybe he didn't but the truth is he should have used some freaking common sense.  A third party is selling a Switch unit weeks before it launches?  That doesn raise any red flags?  Really?
