Is Nintendo Safe from being successfully sued against a Pokemon Go lawsuit?

Yup. Apparently, if someone jumps over your fence, gets into your pool without your permission and they somehow drown, apparently it's your fault for not taking the necessary precautions to avoid that from happening in your own property!

You could kill them for trespassing, but you would also be sued... some lawsuits are completly crazy (my case was a joke, but I certainly accept that in some cases invaders should be shoot if necessary to protect your own safety).

Given that they partially own the company who owns the property, they might be one of the companies named in the lawsuit.

If it's tied to Pokemon Go, then I would say they are pretty safe. Any dumb accidents people may get into, that is on them. Before the game even starts, you are warned. After that, whatever happens is mostly on you.... or terrible scumbags.

On safety standards there is a lot of tiers that you have to comply, levels and responsibilities... in some cases doesn't matter the warning you put or how dumb and out of purpose the use was if someone get injured because of it it's your responsibility.

Who's responsibility? Nintendo's? Well, I'm not really sure how court works, but I think it would be kind of unlikely Nintendo's fault if the person in question got injured from say, getting hit by a car, getting into an accident, or driving into a tree. It's not the app's fault. The person should have been paying attention If it was that simple, there would be a lot of sueing going on involving the app already.

You have an refrigerator, that you are supposed to put things inside to cool down. But you decide to use it to dry your clothings in the condensator outside of the refrigerator. You end up making it hottier and the clothing burns and suddenly you have your whole apartment burnt. Guess what, you may sue and win the refrigerator company for blowing up due to your poor use.

I'm talking about US, but Brazil also have several ridiculous suits... and the responsability charges in US can be very strange if you look on how many different things manufacturers do to prevent themselves from being sued due to poor use of their products.

If your friend thinks that you could sue a company for making something which could be used to lure children into a dangerous situation then I can see why in the OP you say he "used" to practice law.

I wonder how the lawsuits against every sweet company on earth is going? or the lawsuit against Vans or trench coats?
