The point of this thread is that installing Windows 10 one gives explicit permission to MS to do whatever they want to with the personal data. It doesn't mean that is implemented, but the authorizarization is there. Unless this article (the first I could find) is lying, sure:

Nope Windows 10 can't, it's the services from Microsoft can(which Windows 10 or any other Windows are not listed)
