I think that we can't affirm that yet. However, as the architecture is wildly different, I think that we are looking at an emulator here. But it could also be an hybrid hypervisor layer that does a combo of emulator and VM.

In the past, both PS1 and PS2 emulators (on PS2 and PS3 and PSP and Vita) had various options for performance. I hope that when XB1 is done and ready for the public, it offers various options for an optimized experience, too.

Yeah, they went into detail about emulating the OS and difficulties of different architecture. Apparently they have only been working on it for a year. Pretty impressive even if the frame rate isn't ideal.

Spencer claimed the emulator has the same performance as an actual 360. But we see frame dips in the videos and better performance in other scenes. I'm thinking the lack of screen tear is causing frame dips and faster loading makes some scenes perform better.

Kameo

Kameo was one of two Xbox 360 launch titles from Rare and remains a lovely game to this day. It's also one of the best performers in the entire roster of backwards compatible titles, with a near flawless presentation. The frame-rate during our test held rock solid at 30fps, just as we had hoped, and all of the lovely lighting and textures are present and accounted for. It feels every bit as solid on Xbox One as it does on Xbox 360. Of the titles we tested this is the virtual machine working at its best, producing the most accurate 'emulation'.

Status: Virtually perfect.

I'm all for backwards compatibility, but I had a question last night. I don't know if this scenario has been brought up, but what if I had both a 360 and XB1, and I lend my friend, who also has an XB1, all my 360 games available for B/C and he downloads them into his console. When I get those games back from him, will I be able to download them on my console too or will they be limited to his console now?

Again, maybe this has been addressed already, but I haven't heard anything regarding that yet.

Since disk games have no unique ID there is simply no possible way for MS to block you from using that disk or any 2nd hand disk again.
He can't play them anymore though, since you need to have the disk (or any disk with the game on it) in the drive to start the game.

As stated, no disc=no play, even if they're installed in the console.  And digital games (as always) will work for the console they are originally downloaded to, online or offline.  Any other console (XB1 or 360) will require that you sign into your account.  Also, you can't log into two Xbox 360s at the same time--not even a virtual 360 on an Xbox One.  I already tried. :(
