They can work around it for certain deals. I'm not sure what's the point of the parity clause anymore, it's just going to hurt Microsoft more than help them. Especially since the PS4 is the more popular platform now.

I think MS thought the parity clause would force low-budget dev to release their game first on xbox which would gave temporary exclusives for xbox without MS having to pay for.But the situation is the reverse! Low budget devs are releasing their games on PS first(or PC and then PS4).
