I think they were on the eshop but not available 'til this morning. I had the same issue with super mario bros 3 last night. I could not purchase it even though there was a big banner on the eshop promoting it. It did say 4/17/2014 as release date when I attempted to purchase it. So I knew it wouldn't be available 'til this morning.

It was great fifteen years ago to see something like this running on a portable. In 2014, running on a home console? Buyer beware. I got if for 3DS (ambassador program) and it's one of my least favorite GBA titles.
