JEFFERSON CITY, Mo. (AP) -- The Missouri House has approved legislation expanding a self-defense law against home intruders.

 

A so-called “castle doctrine” law approved in 2007 gives Missourians a right to defend themselves and their property. The law says that people can use deadly force to stop an intruder in a home or vehicle. There is no duty to retreat if someone enters illegally.

The measure passed by the House with a 110-39 vote on Thursday would extend that right to people on a property with the owner’s consent. Current law applies only to the owner or tenant of a location.

The legislation now heads to the Senate.

I did not think there was a duty to retreat in most places. Know was a case here where a man killed two thieves in his home and suffered no punishment.

In your own home or car that is the case in most states.

In someone elses home, car or anywhere else, you generally have to try and run away first in most states.



Gun rights? This only applies to guns? I'm confused, the article seems to hint otherwise.



I just wanted to know who voted against this and wanted those whose house is broken into to lay there and get killed willingly.....

It's not about people whose house is broken into.  It's about the other people.

Using the Castle Doctrine say,the three of us were chilling at my house and a robber breaks in.   We run to the back of the house where my kitchen (and gun is).

There is a backdoor behind us.

I can stay in my kicthen and shoot him legally.  Meanwhile, you two can't shoot him.

You have a way to escape, and because it's not your house you therefore have  a duty to try and get away first since you aren't being menaced on your property with stuff you own.

 

This would stay true if say... I went to the store, then the robber broke in.

 

Now if there is no door and the robber is menacing, all three can shoot, as there is no way to retreat.
