Absence of Evidence is not evidence of absence. You don't have number showing how Smash is promotion either.
It doesn't matter if Snake isn't from the "Nintendo Universe", he adds variety to the Roster.
From a Western Centric view: Snake doesn't deserve to be in Smash cause he hasn't been on a nintendo game.
Consider Japan where Snake is more popular then even in the west? You think having him in the game wouldn't intrest players?
The Roster is one of the biggest attactions to the game cause it expands the gameplay and expands the audience at the same time.
It's not just some stupid nintendo only thing.

They should put in every third party character in there too, then. Because those companies actually brought more games. Fact is, metal gear and konami would benefit from this more than nintendo and smash bros would. Didnt the worst selling smash game still sell as much as the best selling metal gear? if only konami had shown more support to wii or at least help wii u with games during the launch then maybe, but as things turned out well obviously nintendo is not happy and doesnt have to do any more favors

Yah, because Sonic's appereance in Smash really improved his Wii Exclusive game sales.
I'm not implying including Snake will increase that value of Smash as a system seller, but it will expand the game's auidence.
It would make a lot more sense for nintendo to advertise a Wii U Phantom Pain, then to put snake in smash to advertise phantom pain. Again, the roster isn't promotion.
Take a step back from your biases and emotions and look at it for what it really is, a buisness decision.

It is a "Nintendo-only" thing... It's Super Smash Bros. A first party series focused on Nintendo's characters and universes, which before Brawl didn't include any 3rd party characters whatsoever. And Sakurai has already stated that 3rd party characters will be limited. They're guest characters.
Now, with this in mind, why should Snake take priority over any of the other popular characters that could be added to the game ? Characters that have more significant history on Nintendo platforms and are more likely to return to them. Characters that also add variety, and would actually be new to Smash. Characters that also have worldwide appeal and potentially great movesets. Why ?
It's not just about getting any popular character in there. There's other factors at stake here.

It's a Nintendo made cross over game made exclusively for Nintendo consoles featuring 99% Nintendo owned characters. It is exactly just a stupid Nintendo thing.
Snake was definitely different in Brawl, but if Konami's going to bring anything to the Smash Bros. table it should be a Belmont.
