Europe is the same. You are not allowed to reference competitors by name in commercials. You can say other consoles in this case, but no specifying.
wow people are so sensitive against anything MS does. Here in Canada, they have offers similar to this for many industry including upgrade your old phone of (replace any brand) and get a (replace brand) for $100 off. Just cause MS said PS3 instead of Wii (can't get $100 for that), Sony fans are all up in arms. A month ago I got rid of my PS3 plus 2 games for $100. Had I known this deal I would have taken it up in a heart beat and trade the games in for more credit.

Thanks for the response. That's a strange rule.

Up in arms? Overreacting much?

The main reason behind is so that companies don't trash talk each other. Otherwise the richer one wins by default.

You're not allowed to elevate your products by talking smack about other products, conduct rules. In my opinion, this kind of advertising is petty. The US being the capitalist HQ of the world, I wasn't really expecting much else. It's fine, I guess.
Wouldn't it be better to start an incentive program where you trade in your 360 and get a good discount or a bunch of gamer points? I mean, one could argue that they want people to stick with the 360 as well and buy software and hardware that is making them tons of money but they're quite clearly telling consumers to jump into the 8th gen.
People taking these things personally should take their chill pills though.

May I ask why? How does it benefit you as a consumer that the biggest companies are left alone to rampage through massive, cynical advertising due to a lack of rules of conduct and competition premises? Competiton is a good thing for consumers and the market in general.
