I...hadn't heard about this. Wow. Just...wow. The problem with the eShop at this moment is probably just from the Christmas rush (Sony and Steam both went down too), but this restriction literally makes no sense to me.

Glad to hear it, and glad to confirm you're the type of dude who can keep things in perspective over the long haul. Still, your earlier points were completely valid. It blows my mind that Nintendo (and Sony/Steam) weren't prepared for what was an obvious rush of folks hitting their servers. Nintendo even tweeted folks who were gifting the system to download the updates before wrapping them up: this wasn't a surprise even to them...

You're kinda kicking Nintendo while it's down, bro. I'm not arguing that Nintendo's online service is on par with Sony's and Microsoft's, but the service has been spotty (not out; spotty. I was able to get in the eShop and download Ducktales and Mighty Switch Force! 2 last night) for two days and you're making it sound like this is the norm. Meanwhile, PSN and Steam are/were having the same problem, albeit on a lesser scale it seems, but their allowed to have a few blemishes on the record.

This is essentially what you're saying:

But it's not a matter of services, it's a matter of reliability!

It wasnt my intention to make it seem like its the norm. Sorry if it came across like this. Yes to a certain extent they are allowed to have a few blemishes, because and this is going to sound messed up the online services are good and that much better than what Ninty offers. Im not even talking this instance im talking their online overall. 

Its a matter of everything, now i acknowledge Ninty is definetly better than they were in the Wii (shudders) but they need to be running with this thing, right now it feels like theri jogging, they dont have that luxury. For the record this isnt anywhere near the crap that was the PS3 hack.

We can shake  hands on that one. But it at least appears that they're sssssssssslllllllloooooooooooowwwwwwwwwwwlllllllyyyyyyyyy coming around, with unified accounts and digital wallets across their handheld and console. Heck, the Wii U's online component and OS has come a bit of a ways since it launched; the OS is significantly faster, downloads now happen automatically upon purchase (and it will continue to download after turning off the system) and the browser and certain apps like YouTube have and will continue to receive updates to enhance performance. It ain't no Xbox Live, but I personally don't expect a free service to be on the same level as a paid premium service. I don't expect NPR or PBS to match Sirius or HBO in quality.

thats fair, im just glad to know that it isnt the crap storm that was the WiiWare that service was free but so was PSN on PS3 and the difference between those is night and day.

Uhm, they have to built in region locking. It's not like it's always there and they unlock it. So they spend time and money on implementing it. Why? Because laws restrict them. Games are not just rated differently but could also be censored or banned. You are an adult, fine. A whole lot of Nintendo's customers are not (but you don't care, right? It's all about you! :P). Nintendo is doing this to be safe from further law shit that has happened during the last decade and will become more and more because companies and even states and unions love how easily they can get money out of it. Some kid is playing a Japanese banned game in Europe? Oh, let him pay tax first, take away that game and sue Nintendo around $1m or ban their products for a while because they used a simple technology that some moron was able to patent in some weird country - it's that easy. Sony's consoles may be region free but all the DLCs are not. You have to circumvent it and they are ok with everyone having tons of different profiles on their consoles just for purchases. They do the same thing, just with digital content. And Sony still is bigger than Nintendo on a whole.


As for the other issue: Nintendo's network has always been bad. They have nice ideas but lack tech and sub-companies (just look at Sony and Microsoft, what they actually are). Nintendo is not thinking global, that's what they do wrong and it might become what makes them go down. Not bankrupt, but less important and unknown, like my favourite speaker producer.

There's a real simple way to get around that while still providing every game to every region:  Any game that has the potential to recieve an adult rating or otherwise require censorship in order to be sold to minors globally should simply be made available exclusively on eshop, unless there is also a localized version. Furthermore, it should only be possible to purchase these games with a credit card, so that prepaid cards aren't an option. Gifting could also be disabled for such games.

This guarantees that if you buy these games you are either the owner of an international credit card (which as far as I know isn't given out to minors) or someone with an international credit card made the purchase for you, meaning they had to approve of your purchase or otherwise agree to help. This would be akin to receiving the permission of a parent or guardian, which I believe is good enough to remove any responsibility from the seller. At the end of the day a minor could still get around this with help from an adult that wasn't their guardian, but it would be no different from getting someone to purchase alcohol for you if you were below the legal drinking age - in which case the seller wouldn't be at fault.

There is an arrogance to Nintendo sometimes but the same is true of most console manufacturers. On the positive side Nintendo has never tried to stop the secondhand trading of games unlike Microsoft. At the current time I think Sony are most in tune with consumers.

Nintendo's network is ridiculous, they are in stone age. I can't understand how anyone can risk spending money in their store! I'm sure I won't pay a dime there until they start a proper account system to which games are tied and stop with this BS that OP is struggling with. Cross-buy between 3DS and Wii U would also be welcome.
