It is not restricted, the title is misleading. It is up to the dev to include it or not in their games nothing is force to them.
While I dont see why a dev will not include Game DVR in theirs projects, because it seems to me that the xbox might handle it by itselft and should not be much of an impact on game budget. Adaptative AI is something else, the difference between AI and evolutive AI that work on a distant server is a big and expensive step and the only thing microsoft is giving them is the infrastructure to do it (which is still awesome IMO).

Might be universal if the devs have the resources and habilities (+ the need or desire) to implemente such feature.

By universal I mean it's baked into the console's OS so it's there for all games and the game dev/publisher don't have to do anything (if that's technically possible of course, I wouldn't know). It's obvious adaptive AI cannot be baked into the OS because it's an aspect of actual gameplay. But DVR I would think is simply recording the image and sounds being fed into the cable going from console to screen so may not require any specific coding from the dev so the function could be baked into the console. Of course perhaps what MS (and Sony) is doing is giving devs the option of disallowing DVR because some devs might, for some reason, not want to have their games DVR'd.
