@kasz and enditall. I take it back, he's making the right legal move, but the legal system is upside down where you guys are. Is it reasonable and fair to ask for a company to spend an assload of money to recall games due to 1 tune when there are many other options? It's an insane request from an outsider point of view.

American Legal System?  That's how pretty much any legal system works... the US is actually pretty damn lenient.  If this was anywhere in Europe or Canada they'd likely force Rockstar to recall and destroy all copies of the CD.  WHILE fining them a huge penalty for every copy not accounted for and destroyed.

If it turns out R* didn't pay him royalties then recalling all unsold copies is a legitimate decision for the courts to make until the matter of compensation is sorted out. And if it goes to the courts then they might decide R* has to pay him 0.5c (0.25c per song) for every copy sold, which would net him $100K. Which would cover both compensatory and punitive damages. Not to mention the cost of lawyers etc to deal with the case.

Personally I think the guy was being greedy and unreasonable in turning down $4K because along with the exposure that's a pretty good deal for a largely unknown rapper. But that's nothing compared to R* going ahead and using the songs without an agreement. I bet all y'all would be looking for a nice pay day if R* or Infinity Ward sent you a letter saying they wanted to use 2 of your songs in GTA or CoD.

R* will either pay him ~$10K to go away or will wave a signed agreement in his face from his record label.

Do not even believe for a second that this will happen. That is just one of those things you throw in there to make sure that they know he is serious.

 

He just wants more money. He most likely full well knows that GTA sells like crazy and generates millions so he probably thought that he would get like 15 or 20k for the songs and probably felt disrespected when they said only 4k lol


Though he'll probably get significantly more now, thanks to Rockstar's fuckup.  Though yeah.  I imagine 3-4 days tops and there will be a settlement.

What will be most interesting to see is if they screwed up by themselves.  Or if a record company screwed up.  Since apparently he has all the paperwork that says he owns the rights to those songs.

Well if his claims are true, a cease and desist is more than reasonable. They essentially stole from him, they stole his songs and shoved it in a product that has made over a billion dollars. If someone stole from me and made profit (even indirectly) from it, I wouldnt be concerned about their financial being from their product.

OT: I don't understand how some of you people think he's in the wrong in this situation. If he refused their offer and they put his songs in the game anyway, he's doing exactly what he should do. He's actually being pretty generous by giving them two weeks to fix this. Youtube doesn't even get that much time.

He's totally right, and trying to show people that it's not because Rockstar's game is great and they have money that they can do anything.

Hopefully, they think of a smarter solution than offering another low bid, or they'll be out of more money than what it would cost to pay him what he wants and patch the game combined.
