Well, Microsoft has a track record here already.
When Microsoft ceased the PlayForSure DRM solution and moved onto the PlayReady DRM solution, all the content available through PlayForSure worked with PlayReady. If Microsoft ceased using the DRM solution on the Xbox One than the content would still be accessible using the new solution's servers. The content itself would still be playable on the Xbox One, the servers and the services themselves would just be different.

Are you willing to take that gamble? Because that's what it is... A gamble.
Plenty of Microsoft games have had their servers shut off in the past preventing multiplayer on the PC, modders actually had to do a bit of work to get it functioning again. Plus, I'm pretty sure all the DLC and other stuff that was available on Live! for the origional Xbox is no longer available and they shut that off only a couple of years ago.

Yes, I'm am. The consumer base for the Xbox 360 is a large one, and it will continue to be for many years.
With the progression from the original Xbox to the Xbox 360, LIVE was a service built on top of the previous one. Rather than independent of it. At the time, server technology didn't really allow for data centers featuring large clusters of virtual servers, so one couldn't plan for a system that came-up on demand. With current virtual server technology, Microsoft can have at some point in the future, older Xbox LIVE servers required for the Xbox 360 or Xbox One, running along side each other based on user need and demand. Microsoft doesn't need to build one service on top of another service as it did with the Xbox and Xbox 360.
