Apple Publishes Petulant Non-Apology Apology To Samsung

As a UK court recently ruled, Apple's UK website is required to post a notice about the court ruling that Samsung didn't copy Apple's design with its devices. Apple has now complied with a tiny link in the page footer:

The notice itself is amusing in its somewhat passive aggressive tone. It first notes the court ruling, and then explains:
In the ruling, the judge made several important points comparing the designs of the Apple and Samsung products:
What kind of important points? Well, all the ones about how Apple's products are awesome, while Samsung's... not so much.

"The extreme simplicity of the Apple design is striking. Overall it has undecorated flat surfaces with a plate of glass on the front all the way out to a very thin rim and a blank back. There is a crisp edge around the rim and a combination of curves, both at the corners and the sides. The design looks like an object the informed user would want to pick up and hold. It is an understated, smooth and simple product. It is a cool design."

"The informed user's overall impression of each of the Samsung Galaxy Tablets is the following. From the front they belong to the family which includes the Apple design; but the Samsung products are very thin, almost insubstantial members of that family with unusual details on the back. They do not have the same understated and extreme simplicity which is possessed by the Apple design. They are not as cool."

And then... it reminds you that other countries have ruled completely otherwise:
However, in a case tried in Germany regarding the same patent, the court found that Samsung engaged in unfair competition by copying the iPad design. A U.S. jury also found Samsung guilty of infringing on Apple's design and utility patents, awarding over one billion U.S. dollars in damages to Apple Inc. So while the U.K. court did not find Samsung guilty of infringement, other courts have recognized that in the course of creating its Galaxy tablet, Samsung willfully copied Apple's far more popular iPad.
In other words, it's the petulant Apple "complying" with the UK judge, while at the same time making sure to add a "but, but, but... the judge is really wrong -- other than the part where he likes our design."

Well the court order never told them to issue an apology, just to state that the court found Samsung had not copied Apple. This petulant reply is completely expected considering Apple's track record. I wonder how long it'll be before Apple employees realise that these responses and announcement do more damage to Apple PR then good.

Wow, that's incredibly arrogant. It's basically an advertisement. Somehow, after reading that, I feel vaguely insulted.

The "informed user" part is pure garbage, and I despise when giant corporations tell me their device is more "cool". The whole thing just makes Apple come off as a massive collection of pricks.

And what the hell is a "crisp edge" and why is Apple supposedly the only company that can pull them off? Do they have a patent for crisp edges, as well? You know, that wouldn't surprise me.

This is all I can think of when I think of the bullshit Apple lawsuit. 


Looks like the UK courts didn't think much of Apple's little marketing stunt. I especially like the Judge's sarcastic comment about Apple requiring 14 days to edit its website.

U.K. court to Apple: Nix those 'untrue' anti-Samsung claims

Less than a month after Apple was ordered to add a court judgment to its U.K. Web site, the iPad maker now has to remove "incorrect" elements of the statement.

Apple has been ordered by the U.K. Court of Appeal in London to remove an "untrue" and "incorrect" statement about Samsung from its U.K. Web site, in which the iPad maker continued to insist that Samsung did indeed copy Apple's products.

The statement, which can be found on Apple's U.K. Web site at the bottom of the page, riled U.K. appeal judges sufficiently to force Apple to remove the statement within 24 hours, reports Bloomberg.

This new ruling comes less than a month after a lower court ordered Apple to add the statement which stated Samsung did not copy the design of the iPad and therefore did not infringe a key Apple patent. Apple did so, but embellished the text with additional detail that was not sanctioned by the court.

The first paragraph of the statement was court-ordered, as laid out by U.K. High Court Judge Colin Birss, in which the text had to include a specific 56-word statement along with a link to the judgment online.

However, the subsequent paragraphs went above and beyond the call of duty in Apple's bid to justify the statement on its Web site.

Apple expanded the court-ordered statement with two comparisons made by the judge in the original case between Apple's iPad and Samsung's Galaxy tablets, noting how the iPad was "a cool design," while noting the Samsung products are "not as cool."

The final paragraph of the expanded statement, however, delivered a scathing attack on Samsung, which noted various similar cases around the world in regards to Apple's design patents for the iPad, including Germany and the United States. The technology giant made it clear that the U.K. ruling in Samsung's favor was a one-off event:

The Cupertino, Calif.-based technology giant requested 14 days to make the changes, which was also blasted by the court.

"I would like to see the head of Apple make an affidavit setting out the technical difficulties which means Apple can’t put this on [the U.K. website]," added Jacob.

I'm surprised but glad they did this. The Apple statement was petulant and insulting to the UK courts.

Apple's excuses during the appeal are comical at best.
