The Motion Picture Group adopted H.264 as the encoding method for all HD content.  So, any HD movies that you view via Xbox LIVE will be encoded with H.264 for the video.  Any video delivered over HTML5 will also be encoded with H.264.

Most current applications on the Xbox 360 are developed using Microsoft Silverlight.  Silverlight is capable of streaming both WMV V1 (a competitor of H.264) and H.264 encoded content.

For a company that in the past had been very much into their own proprietary technology, Microsoft has been very gung-ho about adopting H.264 in its products up until this legal battle.

Presumably MS sided with H.264 before Google decided to buy Motorola to leverage themselves against forthcoming litigation against MS infringements.

Is this the first time G/M have chased anyone for compensation for using this? They must be licking their lips thinking that if this passes they can chase Sony, Nintendo, Apple, Samsung etc. and then all the streaming services I assume would be liable as well e.g. Netflix.

This is all wrong. Microsoft owns Active Sync and is suing Motorola Mobility. Motorola/Google is suing Microsoft for video compression and wifi patents. This is how crap gets into actual news. CVG is wrong too for writing the wrong news.

No, Apple and Motorola have also locked horns on the same issue.  Motorola is attempting to license a FRAND patent at 2.25% of the unit price, rather than at a nominal per unit price because Apple requested they license patents that they own.

It's a very real possibility if Microsoft doesn't settle, true. But that isn't going to happen, that's like saying it's a very real possibility it will be cold tomorrow if the sun vanishes from the sky. The important bit is how likely MS won't settle and how likely it will be cold tomorrow because there is no sun. By using the "if this happens then that happens" sentence structure it takes away the actual calculation of what might or might not happen and is deceptive in language. (not that you were trying to, I'm not implying that).

The question is not, "How likely is it that the Xbox 360 will be banned from sale?", the real question is "How likely is it that MS won't settle before that will happen?".

Same question, but I suspect hardly anyone will answer negative to the second, whereas a fair few intelligent people who aren't thinking a bit deeper will actually answer positive to the first.

Motorola's demands are completely unreasonable to expect the return they are on their patent and any judge will agree with that and simply award a much lower figure - if it goes that far - which it won't. It will be hammered out and an agreement made at the 11th hour as that's how these things work in my opinion.

There was no issue with Motorola and Microsoft regarding any Motorola patents prior to Google buying Motorola.

Only after Google bought Motorola did things go sour.

In fact I'm not just referring to this particular case, but also to all the other countless ones before it. And all the countless ones that will happen after this one, unless the US economy gets so horribly burnt by its own fatherland's laws to persuade politician to change them, at last.
