i always find it funny to read about these things and amounts in the american law-system. this guy files lawsuite against mcdonalds because the coffee was to warm for 100 million and that guy files a lawsuite against nike because the shoes was 1mm to short and blablabla...

Hahaha, NYC is known for ruling in favour of the city, even when it's clearly immoral or in the wrong. She has no chance.

However, if what she said is true, then she /does/ have a case (albeit for significantly less), and should seek a lawyer.
