Looking at this a bit deeper I'm thinking it's not all that bad. As long as what they are after is genuinely just evidence that the hack was downloaded and his twittering I suppose could be of some use if it's incriminating.

 

The Youtube stuff is bollox though how can that be of any use for their case, watching a video of that nature isn't illegal in any developed country.

 

Still don't like it but if I was going all the way with this like Sony is then those things would be prime targets. I suspect the news has been sensationalized to a degree, got took in by that, oops, Not that I agree with any of it on the wider scale but I'm sure the regulars here have already noted me as "anti-sony" so no need to peddle that one. (Not that I was but hey ho, only since this) I do own a PS3 so it does interest me, and a bravia lol...Oh dear.

I'm not even going to try to argue this really. Hotz is accused of breaching DMCA. Which criminalizes circumventing DRM. Which is exactly what hacking your console does. So yes, in essence if Sony wins they can pursue anyone that hacked their console

No it means Sony might sue anyone visiting his site or who searched youtube for videos that might "infringe their rights" for your console. I smell massive corruption here in the justice system. If they start suing anyone over this, or even aim to try to ban individuals from the PSN because they visited a website or watched a video, this questions how much a company can breach individual privacy in the United States of America.

Truly, I do not see how anyone visiting, viewing a video, or hell even downloading the hacks infringes Sony's rights. And no the ToS and EULA is not legally binding, according to Europe at least.

I for one say, can someone please blow Sony's HQ the flip up? Enough is enough.

So, by that logic, it's safe to assume, watching the PS3 hack related video is like watching child porn, in that, they are both illegal.

Doesn't need to be. Its a similar tactic as the RIAA and MPAA. Sony is basically acting like you are pirating some massively illegal content that they have copyrights on all this (patents aren't copyrights). You can't copyright scripts, script somehow falls under patents (which thank god the USA is finally changing its patent laws).

So in a way, if Sony has their way, we all could l at least be fined under the assumption we had intent to crack out systems. Even if we just watch the video on YouTube!
