I still think it is unusal for a patent claim to get to this point. The risk as I see it lays squarely with LG and with the inherent subjectiveness of Patents it is very difficult to be sure of your rights. Currently they will be paying for the warehouses and any other costs of inpounding goods during this 10 period and any further extentions until they get to the point that the product has to be removed or destroyed.

It is the high stakes of this sort of action that normally means nothing happens and it just becomes a protracted legal issue. The issue has already rumbled for years I think this action from LG is going to focus some minds but whoever thinks business is not personal is deluded and this action could spur others to stick it out... Very high stakes indeed.

They could be asked to pay Royalties they could also be asked to remove the product from the market. In fact the inpounded PS3s could be destroyed as part of the disagreement. They could be made to pay compensation for all existing products and then told they cannot sell anymore until they remove the infringed patent.

The most likely outcome is an agreement that will no doubt occur before court makes any decisions and will not doubt involve other patent disputes and large amounts of cash.

Apparently Sony can dodge this ban by simply moving to another port of entry to Europe, it appears the ban only affects the Netherlands (Holland). Seems a bit of cat and mouse could ensue as LG hunt down and try to close the new entry port. Sounds like a logistical nightmare though.

The Netherlands is the curren entry point for PS3s into Europe and the injunction was handed out by a Dutch court. Other European countries could respect the ruling. If the order is extended then I think this becomes more of an issue for the time being the order is doing its job and the likelyhood or relocating further shipments is unlikely.

Royalties hold more profit and stability in them than a lump sum does... I say royalities.

2011 is a good year for gamers, a challenging one for Sony.

one payment is also a good option since sony could change the future PS3s in a way that don't infringe this patent and  then goodbye money from sony to lg... so one single payment could be the royalty from the units already sold and the future prediction of units to be sold... LG would make big bucks now and sony wouldn't have to worry about this no more.
