Property? A kid aint't property no matter how young it is. Though seece, the law as currently written does give the surrogate rights, afterall plenty of surrogates now are carrying babies that are genitically not theirs but they are still considered the "Birth mother."
Surrogacy rights are tricky too, because when you think about it... most surrogates that aren't someone you know well... are likely very poor and pretty much need the money. Even if they did make a law that says surrogacy contracts are now enforceable lots of surrogates could parobably argue they signed under economic distress.
