Forums - General Discussion - Why aren't public shaming a form of punishment for out legal system?

I've heard that such punishments can be quite effective (in terms of correcting behavior), and would definitely be more cost-effective for petty offenses. But as others have said, the moral concerns are too great. It would unleash powerful public ills in ways that wouldn't be immediately apparent, but would be horirble in the long-term.

On a related note, let me add that medieval times (when humiliation was common) were very different from now. There was no Internet back then, for one thing.

If something like this happened today, you would quickly see online searchable databases where everyone can see every crime anyone ever committed. This record would follow you everywhere in the world for the rest of your life.

It's just too draconian.

People can do that anyways.

Aren't there any laws against this sort of stuff?

Anyway my point still stands... it would be much more pervasive if public humiliation became the norm.

no, in fact the public sex offenders database is there so you can protect your own children. In NY sex offenders must register - http://criminaljustice.state.ny.us/nsor/ - and it is common to see fliers sent around the neighborhoods if someone moves into the area. People want to know if they are living near criminals and they have every right to know.

However, NY state doesn't make all offenses publicly available, and if you want other information you'd have to browse old news stories or public databases like the one I originally linked.

Also, this cracked me up when I was browsing the site - "Additionally, the Sex Offender Registration Act (SORA) does not allow a sex offender to work on an ice-cream truck." (it was from the section on if you have to employ them, but I thought it was funny they pointed out ice-cream trucks explicitly)

Lol, that IS funny.

Anyway I was thinking more about things like small theft and mild crimes like that, not things like rape... I wouldn't lift a finger to protect a rapist's right to privacy, as IMO the vast majority of rapists are beyond repair.
