The trademark, but not the copyright. Copyright takes 70 years to expire. Basically what this means is that Nintendo could use the Scalebound name since it is no longer trademarked, but MS has rights to the characters, story, and art assets that Platinum already developed. Nintendo and Platinum would need to start over from scratch and make significant changes, unless of course Alanah is right and Platinum successfully managed to buy the copyright back from MS. 

Not going to be much of an issue considering MS changed the game heavily which ironically means PG can just change the main character and make the game they originally envisioned.
