I don't see this going anywhere. Republicans control the House and Congress. Even though some dumb dumbs like McCain and Ryan want to backstab Trump, they are not stupid enough to vote for impeachment (especially on such a weak issue). They want to actually win re-election. It's bad optics and the representative is stupid for trying this. If the Democrats actually want to impeach Trump, don't try it at every avenue. 

But none of that has anything to do with being President. The judicial branch intreprets law, the executive does not. The absolute that Pence could do is given a directive to the Department of Justice, but event then, that doesn't change any law.
