Modding is up to devs, just like it was this gen and the gens before it. Game devs can do what they want with their code as long as it isn't a security breach. Also most mods use extra system resources so putting them on consoles is risky.

Xbox one dev kit != xbox one running as a dev kit. Real dev kits, the ones that cost thousands, have better specs such as 12GB of ram. If you want to make a big game comparable to battlefield or final fantasy, you will need a REAL dev kit. What the xbox one running as a dev kit allows is smaller indie games. It is xna 2.0. That's actually great for us indie devs who don't have aaa resources, but it's not amazing like you think.
