First Question: I'm not sure what you mean. You do not need Xbox Live Gold to connect online. But you need it to do anything cool online.
Second Question: You can set the Kinect settings to the levels you want. If you don't want it turning on by saying "Xbox On" then you turn that part off in the settings and push a button to turn it on. So it will be off and not listening. They confirmed this last week.
I know people that turn their router and modems off when they aren't using them. It’s a matter of personal preference and security.
