DS was one of the systems that sold the biggest number of software last gen, even with R4 and Acekard, so I guess your point doesn't apply here. Piracy probably didn't influenced a lot of people when they thought about buying the handheld, seeing as software sales on the DS were very high. PSP, though, was mostly a failure for third-parties, since few games on it sold well thanks to piracy.
