Hard to say without knowing what's in store for the second half of 2013.

By the way, after 95 weeks the 3DS has sold over 1.1 million hardware units more than the DS had at the same point. It's basically going into 2013 with a head start.

In the 52 weeks following week 95, the DS roughly doubled its LTD hardware sales, selling about 25.9 million units. So the 3DS has to sell over 24.8 million consoles in 2013 to stay ahead of the DS. Very difficult for sure, but hardly impossible for a handheld that is home to Monster Hunter, Mario, Pokémon, and Animal Crossing.
