Pretty much this.

"The software" doesn't work on absolute distance values, it reacts to change of depth. It doesn't know (and doesn't need to know) that there is a lense attached to Kinect. Therefore the idea works in principle - although, with such a system, you considerably lose on depth range. Since Kinect still seems to be two player limited (side by side), this probably is not much of a problem.
